In addition to my mail I would like to share with you the novel Legal Approximation Inventory which was elaborated by the MFA with support of AA/DCFTA project and in active cooperation with all line Ministries including the MOH.

 

The table N 18 is about Public Health where you will find the state of play of implementation of the respective AA Provisions related to Public Health.

Thanks for your e-mail,

 

Unfortunately it’s not possible to provide this information in such a short notice and particularly taking into account that XXXI Annex of the AA (Public Health) falls under the Dynamic Approximation with the EU and number of the respective EU Directives and Regulations from the Annex has already been changed within the EU acquis and the process of updating the AA (XXXI Annex) is underway. Together with the MOH, we launched consultations with the EU regarding update of the XXXI Annex which also involves update of the terms for implementation. Despite the fact that Annex was verbally agreed even before start of Pandemics, we have not yet received any feedback from the EU services regarding the father steps. As you might note, this issue was subject of discussion at the end of the latest Sub-Committee meeting.

 

For more clarity, I am attaching the XXXI Annex (Clean/initial) and also the one with applicable changes agreed with the EU. As for the indicative timelines, you will find them within the Annex itself: - for instance where there is an indication that “Directive's provisions shall be implemented within six years of the entry into force of this Agreement” that means it should have been met in 2020. Changes are mainly apply to those provisions which terms has run out and new implementation terms has to be defined after update of the annex.

I hope you are doing well and sage the colleagues  in DG SANTE asked us to provide  them with indicative timeline for the legislative alignment checks to be performed for Georgia in relation to the Association Agreement (AA) and the domain of Public health acquis foreseen in 2021-2022.

Article 357 of AA

Georgia will carry out approximation of its legislation to the EU acts and international instruments referred to in Annex XXXI to this Agreement in accordance with the provisions of that Annex.

 

To facilitate the future work and for better planning on the legislative alignment checks within DG SANTE, could you please provide us with the indicative timeline in quarters of the legislative alignment checks to be performed in the period of 2021-2022 for Georgia. In my understanding this information should be checked with Georgian authorities.

 

Having in mind the MFA role in overall coordination of the AA implementation and legal approximation process, we  would appreciate if your services could  send us the indicative timeline by 23 of March cob.
