The letter does not really confirm the parts highlighted in yellow:
1.04A (b) confirmation
that all necessary consents, authorisations, rights of way, or approvals of governmental or public bodies or authorities required in connection with this Contract and the Project have been received
and that the Promoter, to the satisfaction of the Bank, has been given the necessary authority and powers
to operate the Project; and 1.04B (a) (vii) evidence that the Borrower or the Promoter as the case may be
has received all necessary Authorisations to proceed with the stage of the relevant Schemes being financed by the Loan contemplated by the Disbursement Offer and to operate these Schemes under all applicable
laws.
The part in green could be considered as satisfied if the reference is done to the Project and not projects of similar nature.
We usually expect to see something along these following lines: with reference to (name of the project/ finance contract number), we hereby confirm that we have all necessary consents,
authorisations, rights of way, or approvals of governmental or public bodies or authorities required in connection with this Contract and the Project have been received and that (add the Promoter’s name) has received all necessary Authorisations to proceed
with the stage of the relevant Schemes being financed by the Loan contemplated by the Disbursement Offer and to operate these Schemes under all applicable laws.

I hope this email finds you well.
First, as agreed during the call last week, we have drafted a letter to finalize remaining CPs (1.04A – (b); 1.04B (vii)) for the first Tranche of the loan disbursement (draft letter, attached). Please review, and if it is acceptable, we
will send it officially.
The second outstanding issue is a project procurement plan, which was shared with you as soon as the loan amendment has been initiated. However, it has been requested from the Bank’s side recently, to transfer all procurement activities
into the special format and package them as appropriate. Consequently, please find an example enclosed and if it is satisfactory for the EIB, we will change existing procurement plan accordingly and share it with you very soon.
Third issue which we also find very critical, is project procurement procedure and possible thresholds (50 000 EURO for DC) which you have mentioned during the call. As you may see in the procurement plan, given the urgency to provide beneficiaries
with the critical equipment and diagnostic supplies due to the COVID-19 crisis, the existing project procurement producers allows PIU, after proper justification and No-Objection from the bank, to procure goods directly from the suppliers without any thresholds.
This is regulated by the new Standard Procurement Documents (SPD) which was specifically prepared by the WB for COVID-19 Emergency Response, to support the procurement of medical and other necessary Goods under COVID-19 Emergency response operations.

as a procurement term, was shared with the EIB at an early stage of the loan negotiation (file name EIB proposal_MOISHLA) and is rationale behind PIU’s comment on the Loan Agreement, related to the selection of the WB procurement guidelines.
Hence, the promoter considers reasonable to use the World Bank’s new streamlined Standard Procurement Documents (SPD), that based on our experience, accelerates the procurement procedures, that is once again vitally important due to urgency
of the needs to be addressed during the pandemic. Moreover, no procurement will be made without prior review of the EIB. Thus, if EIB ‘s expectation is to follow standardized procedures (the WB or EIB), we doubt that the project’s Covid-19 related scheme
(as per loan agreement, duration is until the end of 2021) will be very challenging to implement.
Fourth, for the smooth project implementation, EIB’s dedicated staff should be recruited urgently under the PIU. Thus, we need to receive green light from your side to announce all vacancies (TOR’s were shared with you earlier on). It is
important to once again emphasize that the selection will be made by the Ministry and EIB’s no-objection, based on interviews and relevant assessments, using simplified procedures (assessment of three major candidates). Plus, for the sake of the project sustainability,
no threshold (other than monthly salaries, shared prior with you) is expected from EIB’s side. PIU contracts mainly have one year duration and contracts termination and continuation is regulated in accordance with the Project’s selected procurement guidelines.
