Many thanks for all the efforts you put into these ToRs. Please allow additional week for us to circulate among the relevant ILO staff for further comments to finalize from outside. In the meantime, have you decided how you are going to select the consultants? do you or social partners have nominees that we could start requesting their CVs?

I hope you had a nice weekend.

We are glad to hear that the latest meeting with the social partners and mediators has yield fruitful follow-up.

On the first request relating to the development of a mediation mechanism and code of conduct, I will discuss the matter internally with the relevant ILO specialists and get back to you with a proposal.

With regard to the second matter, I discussed with Ms. Barkalaia that ILO has only the option of signing a contract with external collaborators as consultants. This means the contracts would need to be specific with a clear objective(s), time-bound, and combined with concrete deliverables (milestones) in which ILO will consider for filing payment orders.

In order to proceed with the two consultants, may I ask you to provide the following:

  • Objective(s) of the task -- what does the Ministry envisage to achieve by the end of the task/assignment?
  • Deliverables - normally every ToR has one or number of deliverables such as study, assessment, SoPs, mechanisms, evaluation, training etc. The add-up of the deliverables should achieve the objectives stated.

Once we receive the requested information, we can provide our suggestions, request CVs and then proceed with the contractual procedures.

Dear Kinan,

Hope you all are in a good health.

Following our meetings with mediators and internal discussions it’s time to work on mediation mechanism/amendments. The most important topic right now is co mediation and we would like to ask you to share ILO’s views on how to deal with it, what is the mechanism in this case, how responsibilities of mediators are redistributed, process of mediation, what are the best practices, how other countries deal with it, etc.

We also consider working on mechanism of evaluation of mediators and your expertise would be very much appreciated. Besides that, you might remember discussions from our last meeting with mediators the issue of ethics code of mediators, we would like to know more about procedures, can the code for members of Georgian Bar Association used in case of collective labour dispute mediators and others.

As I’m aware, you already discussed the issue of hiring two experts with Mrs. Barkalaia. Considering the needs and scope of the Ministry, the experts should be lawyers having knowledge of labour law, knowledge of English language is a must J work experience in public institutions or knowledge how public sector works would be an asset.

We need those experts to work in two main directions:

- Development of collective labour disputes mediation mechanism (amendments, practical issues, etc.) and tripartite social dialogue/TSPC (make the system more efficient, more meetings, other related issues);

- Labour Inspection – legal acts that need to be adopted and are determined by the Law on Labour Inspection, number of practical issues related to work and functioning of a new body, organizational structure, etc.
