Dear Deputy Minister

I am writing to request support from the MoIDPLHSA in regularizing Heinrich Duffner’s legal right to remain in Georgia. Unfortunately the Public Service Agency (Justice Hall) has revised the documentary requirements to be met by applicants for a Labor Residence Permit by requiring an additional document issued by LEPL Revenue Service proving that the annual turnover of the enterprise “is not less than GEL 50 000 for each foreigner employed”. Unfortunately the latter requirement cannot at present be satisfied because, although GOPA is currently going through a process of registering a representative office in Georgia, all financial transactions relating to the project including both incoming and outgoing payments are currently handled through the company’s head office in Germany, and cannot be certified by the Revenue Service in Tbilisi.

Because of this recent requirement, it seems that we cannot satisfy the documentary requirements for Heinrich to receive a Labor Residence Permit. However, Section 15 of the Law of Georgia On the Legal Status of Aliens and Stateless Persons provides that a Special Residence Permit may be issued to “an alien in respect of whom a member of the Government of Georgia submits a written initiative on the issuance of a Georgian residence permit”. The regulation requires only the following documents to be submitted with an application for a Special Residence Permit:  photocopies of passport and document evidencing lawful stay in Georgia (entry stamp) – both attached – and written application of a member of the Government of Georgia.

Thus, Heinrich may receive temporary residence registration upon request of the Minister of Labor. I should be grateful if you would kindly ask the Minister to send the necessary letter to the Minister of Justice, with copy to the project so that we can initiate Heinrich’s application.
