Mr. Clarence NELSON
Legislation: age of recruitment is 18. Recruitment before is not criminalized and can it be rectified and how long it needs.
Chapter of Child rights of the and action plan: does this plan involve any obligation under OPAC.
Interagency commission: What OPAC activities are undertaken?
Policy and strategies: It is not quite clear whether it deal with OPAC activities and obligations.
National Budget: is there any allocations for OPAC activities. If there is, can you point out and give us details.
Dissemination and awareness raising: Whether this has been carried out and measures you have been undertaking.
Paragraph 52 training of judges and judiciary with UNICEF on CRC and police officers and investigators and does it include OPAC.
Are there public awareness programs that target OPAC obligations.
Paragraph 52 school curricula but it does not say it extends to issues to recruitment and other issues covered by OPAC.
Data: Children gone and returned to Syria. You say you had no children has been connected to terrorist groups and we have information that there are in particular in Pankisi gorge. We have information on individual children.
Child victims and reintegration: you mentioned program for returning migrants but it does not specifically include such children but it can be extended. Returning children and returning adult is quite different. Children is traumatized and they need specific assistance and do you have any measure that will aim at their reintegration to society.
Children that they are in occupied region and how do you integrate them.
Military school: exact age of such exceptional enrollment for school and why law has introduced such exception.
Cadet military Lyceum: CRC committee is seriously concerned that those children are trained under use of weapons.
The pupils are civilians and not military servicemen. As long as you describe them civilians, you are calling them Cadets and how they can be civilians and at the same time Cadets. If they are considered to be civilians, why they are trained for the use of weapons and are they subject to military discipline? Are they free to leave institution any time they wish and weather they have independent complaint procedures? You mentioned board of trustees but we don’t consider it as an independent.
Enrollment in high military institution is for persons finished high school at the age of 15 and it is for becoming army officers but at the same time you mention prior to call up to armed forces students have to sign contracts?
Terrorist organizations: recruitment of children by non-state armed groups and you don’t have criminalization explicit for that purposes. Recruitment children for terrorist groups we wish to be the aggravating circumstance.
Pankisi gorge: information reveals that recruitment is taking place by certain individuals who are associated with ISIS and they travel outside the country. They travel to Turkey, in some cases without the consent of parents and some of them were killed there and what kind of measures are taken to prevent recruitment. Some families travelled to Syria, what is taken to fight radicalization of children.
Mechanism of early identification of children entering the state party involved in the armed conflict. Question 8 is talking on foreign children involved in armed conflict, who actually need serves.
Extraterritorial jurisdiction: you are applying double criminality condition and we want you to consider its abolishment. Most important is to fight impunity. If recruitment is committed in foreign state and
child returns here, is it considered as against interest of Georgia.
