para 28 (b)
– CCG Art 255.2
criminalizes the child pornography, including buying, storing, attending the demonstration of, offering, disseminating, transferring, advertising,
providing access to or using pornographic work containing images of minor. All these actions obviously include the component of “possession”. One can not simply store a pornographic material without possession! Furthermore, the term “providing access
to pornographic work containing images of minor” is very wide and flexible and includes import, export and possession any other actions that could not even be indicated in OP. Therefore, Georgian legislation in that part is more
comprehensive
და flexible.
-
para 30. –
CCR Art 5 regulates the issues of extraterritorial jurisdiction. Georgia can prosecute the
citizen of Georgia, the stateless person or the citizen of other country, if he/she commits the serious or grave crime abroad (which is a crime in Georgia but not in the country
of commission) and this crime is against the interest of Georgia (incl. Georgian citizen) or the criminal responsibility is imposed under the international treaty.
