შერიგების სამინისტრო ეწინააღმდეგება ამ ფორმით ჩანაწერს. შესაძლებელია, რა თქმა უნდა, თემა გავაჩინოთ, თუმცა ამ ფორმით მიუღებელია. წინა ანგარიშში როგორ ან რატომ დავეთანხმეთ დე ფაქტო ხელისუფლებასთან თანამშრომლობის ინიცირებას?  არ გვქონდა ამ ფორმულირების შეცვლის შესაძლებლობა?

ანა მადლობა დოკუმენტებისათვის,

 

მე მაქვს ერთი მოსაზრება, რომელიც მსურს გაგიზიარო.

 

მართალია, დოკუმენტებში აღნიშნულია, რომ აფხაზეთი, საქართველო და ცხინვალის რეგიონი/სამხრეთ ოსეთი, საქართველო, ეფექტური კონტროლის  მიღმა იმყოფება, თუმცა, რეკომენდაციების ნაწილში არაფერი არ არის ამ მიმართულებით აღნიშნული.

 

მინდა ყურადღება გავამახვილო, 2014 წლის CEDAW Concluding Observations-ზე, სადაც არა მხოლოდ ფაქტობრივი სიტუაციაა აღწერილი, არამედ აღნიშნულია, რომ საქართველო განუხრელად ცდილობს დაიცვას ამ ტერიტორიებზე ადამიანის უფლებები და ამავდროულად კომიტეტი მოუწოდებს ამ მიმართულებით მუშაობის გაგრძელებას:

 

Applicability of the Convention

12. The Committee takes note that Abkhazia region, Georgia, and South Ossetia/Tskhinvali region, Georgia, continue to be outside of the effective control of the State party, which has impeded the implementation of the Convention in those territories. The Committee is particularly concerned about the violation of the right of large numbers of internally displaced persons and refugees, including women, to safe return.

13. The Committee notes the State party’s commitment to ensure that human rights are adequately protected throughout its territory. The Committee encourages the State party to continue its efforts, through the Special Interagency Commission, and initiate cooperation with the de facto authorities of Abkhazia and South Ossetia and other relevant stakeholders to afford women in those areas full and equal enjoyment of their rights.

 

შესაბამისად, რამდენად შესაძლებელია ამის ასახვა ასევე დავაფიქსიროთ? მესმის, რომ ეს კომიტეტის უფლებამოსილებას განეკუთვნება, თუმცა, ჩვენი ტერიტორიებია, კონვენცია ამ ტერიტორიებზე ვრცელდება და კომიტეტის დუმილი მიმაჩნია, რომ არ შეესაბამება არსებულ სამართლებრივ ვალდებულებებს.

 

თანაც, უამრავი ინფორმაცია მივაწოდეთ ჩვენი მცდელობების შესახებ დავიცვათ აქ ადამიანის უფლებები.
