გადავხედე მომერანდუმს. გარკვეული ტექნიკური შენიშვნები აქვთ შეტანილი (ტექსტი გადანომრილია, one months-ის ნაცვლად წერია 30 days; დანართის სათაურს დაემატა პროექტები და ჩამოყალიბდა: „The Project and the Key Objectives”; “General project timeframes”-ს დაემატა სიტყვა და ჩამოყალიბდა „General and indicative project timeframes”; ასევე, თავიანთი ორგანიზაციის დასახელება და მისამართია ჩასწორებული და მცირე ორთოგრაფიული ცვლილებები).
ჩვენ შინაარსობრივ შენიშვნებს რაც შეეხება (იხ. 8.1 პუნქტი), სრულად გათვალისწინებულია, თუმცა ასევე, დამატებული აქვს ერთი ფრაზა - „Except clauses 5.2 to 5.4 (inclusive)”, რომლის თანახმად 5.2 და 5.4 პუნქტები რჩება სავალდებულოდ, რომლებიც ეხება კონფიდენციალური ინფორმაციის გაუთქმელობასა და აღნიშნული ინფორმაციის ნებისმიერი სხვა მიზნისთვის გამოყენებას.
შესაბამისად, 8.1 პუნქტი ჩამოყალიბდა შემდეგი რედაქციით:
8.1 Except clauses 5.2 to 5.4 (inclusive), this MOU is not binding for any of the Parties and shall not cause any liability to any of the Parties. This MOU
does not create an exclusive right to negotiate (in particular, it does not restrict the right of the Ministry to negotiate with other interested companies on
similar terms and objectives defined by the MoU) or an obligation to continue negotiations. Each Party may terminate negotiations at any time in its sole
discretion. Each Party will not be bound to an agreement unless and until each Party reviews, approves and executes a final and definitive written agreement.
For avoidance of any doubt nothing contained in this MOU may be construed as binding or committing each Party to share information, negotiate or conclude
any agreement in connection with this MOU.
