Dear Mr. Dieckerhoff,

Upon your request, on behalf of the Ministry of Internally Displaced Persons from the Occupied Territories, Labour, Health and Social Affairs of Georgia, I would like to kindly inform you that according to the national legislation, patient is allowed to bring into the territory of Georgia certain amount (10 commercial packages) of medicine including unregistered medicines of 2nd and 3rd group for personal use.

The following list of medications are applicable to be imported in Georgia:

Tamsulosin

creon capsules

salbumatol drops

inhalation therapy with saline solution

Isozid 300 mg

Eremfat 600 mg

Methotrxat 

If the amount of imported medicine (2nd and 3rd group) for personal use exceeds 10 commercial packages, patient should provide medical record/document (Form N IV-100/ა) together with the prescription to the Customs Service in order to get permissions for the import of the certain number of medical products indicated in the prescription.

It should be noted that the medications: Eremfat 600 mg  and Isozid 300 mg are not registered in Georgian pharmaceutical market and we do not have the specific information about them, but according to the information obtained, they should not contain substances under special control or equal to them. Therefore, they were conditionally classified as group 2.

As for the medication Methaddict, this drug is not allowed in Georgian market, since it contains a narcotic substances. Therefore, the procedure for its import into Georgia has been approved by the Order N01-32 / N of the Minister of Labor, Health and Social Affairs of Georgia.

In order to bring drugs or psychotropic substances purchased in other country for individual needs into the territory of Georgia, an individual shall submit to the Customs Service of Georgia, together with the customs declaration:

(A) A copy of the prescription, translated into English, certified by a competent authority in accordance with the legislation of the country from which the natural person departs. The prescription should indicate the name, surname, gender, age, diagnosis, trade and generic name of the drug and / or psychotropic substance, dosage form of the drug, tablet (s), ampoule, etc. Number, order of administration, and duration of the prescribed treatment course (if the prescription form in the given country does not require the completion of the above data, then the data shall be included in the document referred to in subparagraph (c) of this paragraph);
B) Certificate of prescribing physician, translated into English, certified by the appropriate authority in accordance with the legislation of the country from which the natural person departs;
(C) a document confirming the authenticity of the prescription and the certificate, signed and stamped by an authorized person, issued by a duly authorized body of the country of departure of the natural person. The document shall indicate the name, legal address, contact person, telephone number and country of destination of this body.

ფიზიკური პირის ინდივიდუალური საჭიროებისათვის სამკურნალო საშუალებების,  მათ შორის, დაურეგისტრირებელი მე-2 და მე-3 ჯგუფის ფარმაცევტული პროდუქტის:

საქართველოს ტერიტორიაზე შემოტანა განსაზღვრება შემდეგი ოდენობის მიხედვით:

ა) სამედიცინო დოკუმენტაციის გარეზე ფიზიკური პირის ინდივიდუალური საჭიროებისათვის არაუმეტეს ათი სტანდარტული შეფუთვისა წამლის მოქმედების მიმართ, მისი პირადი პასუხისმგებლობით;

ბ)თუ საქართველოს მოქალაქე ფიზიკურ პირს  ესაჭიროება სამკურნალო საშუალება ათ სტანდარტულ შეფუთვაზე მეტი ოდენობით, მაშინ სამკურნალო საშუალების საჭირო რაოდენობით ქვეყანაში შემოტანა ხორციელდება შესაბამისი სამედიცინო დოკუმენტაციის საფუძველზე, სამკურნალო საშუალების დღიური დოზის გადაანგარიშებით მკურნალობის კურსზე.

გასათვალისწინებელია, რომ სამკურნალო საშუალებები: Eremfat 600 mg  და Isozid 300 mg  საქართველოში რეგისტრირებული არ არის.  შესაბამისად, ვერ ვფლობთ მათ შესახებ დაზუსტებულ ინფორმაციას, თუმცა, მოძიებული ინფორმაციის მიხედვით, ისინი არ უნდა შეიცავდეს სპეციალურ კონტროლს დაქვემდებარებულ ან მათთან გათანაბრებულ ნივთიერებებს. ამდენად, ისინი პირობითად  მივაკუთვნეთ მე-2 ჯგუფს.

წერილში ჩამოთვლილი 8 დასახელების სამკურნალო საშუალებიდან მხოლოდ ერთი მიეკუთვნება პირველ ჯგუფს (Methaddict), (ეს საშუალებაც არ არის დაშვებული საქართველოს ბაზარზე, მაგრამ, სავარაუდოდ, შეიცავს ნარკოტიკულ საშუალებას), შესაბამისად მისი  საქართველოში შემოტანის წესი დამტკიცებულია საქართველოს შრომის, ჯანმრთელობისა და სოციალური დაცვის მინისტრის N01-32/ნ ბრძანებით, რითაც გათვალისწინებულია შემდეგი:

ფიზიკური პირის მიერ ინდივიდუალური საჭიროებისათვის სხვა ქვეყანაში შეძენილი ნარკოტიკული საშუალებების ან/და ფსიქოტროპული ნივთიერებების საქართველოში შემოსატანად საქართველოს საგადასახადო ორგანოებს საბაჟო დეკლარაციასთან ერთად წარედგინება:

ა) ინგლისურ ენაზე თარგმნილი, უფლებამოსილი ორგანოს მიერ იმ ქვეყნის კანონმდებლობით გათვალისწინებული წესით დამოწმებული რეცეპტის ქსეროასლი, საიდანაც მოემგზავრება ფიზიკური პირი. რეცეპტში მითითებული უნდა იყოს ფიზიკური პირის სახელი, გვარი, სქესი, ასაკი, დიაგნოზი, ნარკოტიკული საშუალების ან/და ფსიქოტროპული ნივთიერების სავაჭრო და გენერიული დასახელება, წამლის დოზირებული ფორმა, ტაბლეტის (აბის), ამპულის და ა.შ. რაოდენობა, წამლის მიღების წესი და დანიშნული მკურნალობის კურსის ხანგრძლივობა (იმ შემთხვევაში, თუ მოცემული ქვეყნის რეცეპტის ფორმა არ ითვალისწინებს ზემოაღნიშნული მონაცემების შევსებას, მაშინ აღნიშნული მონაცემები შეიტანება ამ პუნქტის „გ“ ქვეპუნქტით გათვალისწინებულ დოკუმენტში);

ბ) ინგლისურ ენაზე თარგმნილი, შესაბამისი ორგანოს მიერ იმ ქვეყნის კანონმდებლობით გათვალისწინებული წესით დამოწმებული რეცეპტის გამომწერი ექიმის სერტიფიკატი, საიდანაც მოემგზავრება ფიზიკური პირი;

გ) რეცეპტისა და სერტიფიკატის ნამდვილობის დამადასტურებელი, უფლებამოსილი პირის მიერ ხელმოწერითა და ბეჭდით დამოწმებული დოკუმენტი, რომელსაც გასცემს შესაბამისად უფლებამოსილი იმ ქვეყნის ორგანო, საიდანაც მოემგზავრება ფიზიკური პირი. დოკუმენტში აღნიშნული უნდა იყოს ამ ორგანოს დასახელება, იურიდიული მისამართი, საკონტაქტო პირი, ტელეფონი და დანიშნულების ქვეყანა.
